Determining Income for Support

I utilize my financial and investigate skills to search for all sources of income that can be used in the calculation of child support, temporary spousal support, long-term spousal support, or permanent spousal support (Section 4320).

My evaluation of income for use in support calculation may include, but is not limited to, an analysis of financial documents, an analysis of business documents, and an analysis of self employment documents.

Because income is more than a pay check, I utilize discovery tools to ensure that all sources of income, including work benefits, income from rental properties, bonuses, and tax deductions, are found and used to calculate support.

Modifications of Spousal Support or Child Support

When there are changes in circumstances, an individual may ask the court to modify a previously entered spousal or child support order. Significant changes in circumstances include changes in child custody arrangements, changes in the earning capacity of either party, or other changes in obligations and assets of the parties.

If an individual is not working, I will use experts to determine whether the individual would benefit from a vocational evaluation or working with a career counselor. If they are disabled, I confirm the disability award to ensure that it is correct.

Permanent Spousal Support (Family Code Section 4320)

Temporary alimony is not sufficient in certain circumstances. Some individuals may be eligible for long-term spousal support following a divorce, provided the party seeking permanent spousal support has not been convicted of domestic violence. As an experienced California spousal support lawyer, I guide clients through the process of determining eligibility for long term support. Some factors considered by the courts when determining edibility for long-term support include:

  • Would it better serve the interests of the children?
  • The individual's potential marketable skills
  • The individual's earning capacity
  • The individual has past working experience
  • The marital standard of living
  • The duration of the marriage
  • The age and health of the parties
  • The obligations (debt) and assets of the parties
  • Was there domestic abuse?
